Introduction to the Terms of Use Agreement:
Our online store welcomes you and informs you that you will find below the terms and conditions regulating your use of this store and all the legal effects resulting from your use of the store’s services over the Internet via this electronic platform, as the use of the store by any person, whether a consumer of a service or a store product or otherwise, is an approval and acceptance from him and he is fully qualified according to Sharia, system and law for all the articles and provisions of this agreement and it is a confirmation of your commitment to its regulations and what is mentioned therein, and this agreement applies to all types of dealings between the consumer and. This agreement is considered valid and effective once you approve it and start registering in the store in accordance with Article Ten of the Saudi Electronic Transactions System.
Article One – Introduction Definitions:
The above introduction is an integral part of this agreement, and below you will find the meanings and definitions of the main terms used in this agreement:
1- Jehabe This definition includes all forms of the online store, whether it is an electronic application, a website on the Internet, or a commercial store.
2- (Consumer) The person who deals in electronic commerce in order to obtain the products or services provided by the store through its electronic platform.
3- (Agreement) This term means the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article Two – Consumer Legal Capacity:
1- The consumer acknowledges that he has legal capacity recognized by Sharia and the system to deal with the store, or that his age is not less than eighteen years.
2- The consumer agrees that in the event of his violation of this article, he will bear the consequences of this violation before others.
Article Three – Nature of Obligation:
1- The store’s obligation towards consumers or consumers is to provide (the service or product).
2- The store may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.
Article Four – Controls for Use:
1- The consumer is obligated to use the store’s electronic platform in accordance with public morals and regulations in force in the Kingdom of Saudi Arabia.
2- The consumer is obligated, when purchasing a service or product from this store, not to use this service or product in a manner that violates public morals and regulations in force in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations:
Upon submitting an application to join membership in this store as a user, you are obligated to disclose specific information and choose a username and a secret password to use when accessing the store’s services. Thus, you have agreed to:
1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify this store immediately of any unauthorized use of your account information with the store or any other breach of your confidential information.
2- The store will not be liable in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of disclosing the consumer name or password information.
3- You are committed to using your account or membership with the store yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use the store in your name and on your behalf.
4- You are committed to using the store with all seriousness and credibility.
5- You are committed to disclosing true, correct, updated, complete and legal information about yourself as required during registration with the store and you are committed to updating your data in case it changes in reality or if necessary.
6- Our store is committed to dealing with your personal information and contact addresses with complete confidentiality.
7- If the store finds that you have disclosed false, incorrect, outdated, incomplete, illegal information or information that is in violation of the User Agreement, the store has the right to suspend, freeze or cancel your membership, store and account on the platform, without prejudice to the store’s other rights and legitimate means of recovering their rights and protecting the rest of the consumers.
8- In the event of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership or block you from accessing the store’s services again.
Article Six – Electronic Communications and Official Means of Communication:
1- The parties to this agreement agree that communication is done via the email registered on the platform.
2- The consumer agrees that all agreements, advertisements, data and other communications provided electronically are equivalent to their written counterparts, and are an independent argument in meeting regulatory and legal needs.
3- The consumer agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the store management broadcasting general messages to all consumers or to specific users of the store
Article Seven – Amendments to the User Agreement and Fees:
1- In the event that any article or clause mentioned in this agreement is cancelled or that any article or clause mentioned in this agreement is no longer valid, such a matter does not cancel the validity of the remaining articles, clauses, rules and provisions mentioned in this agreement and they remain in effect until further notice from the store management
2- This agreement – which is amended from time to time as appropriate – constitutes the mechanism of work, understanding and agreement between (the consumer) and (the store)
3- The store may impose fees on some consumers, depending on the offers, products or services they request or the fees or taxes imposed by the state on the nature of the product or service.
4- The store reserves the right to add, increase, reduce or deduct any fees or expenses under the articles, terms and provisions of the User Agreement, for any consumer, regardless of the reason for their registration.
Article Eight – Payment and settlement services for stores in the store
1- The store provides, through its partners, the payment and settlement system in the store, which can be done entirely online through the payment options available on the store or through any payment method provided by the store from time to time.
2- The store is committed to setting the price of the service or product that it displays in its store according to the recognized market value.
3- The store is committed to providing invoices, receipts and receipts for all amounts and profits that arise in its store, and is committed to giving the consumer an invoice for his purchase of a service or product
4- The store is committed to providing the recognized accounting specifications in its electronic store, in application of the provisions of this agreement, and for the legal, economic, commercial and organizational interests in this organization.
Article Nine – Intellectual Property:
1- The intellectual property rights of the store are rights owned by the store in full, whether they were owned by them before or after the establishment of this electronic platform.
2- The consumer or consumer respects the intellectual property rights of the store, which include the name of the store itself, and the words, logos and other symbols of the store or displayed on it, as every right that follows the name of the store are rights owned by the full intellectual property of the store.
Article Ten – Store Responsibility:
1- The store is committed to practicing its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.
2- The store does not bear any claims arising from errors or negligence, whether they are caused directly or indirectly or by the consumer or by a third party such as shipping companies.
3- Jehabe, its employees, owners and representatives are committed to ensuring that the (product or service) is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Eleven – Restriction of Access or Membership:
The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform’s services at any time and without notice and for any reason, without specifying.
Article Twelve – Applicable Law or Regulation:
This User Agreement is governed and formulated in accordance with the laws, regulations and legislation in force and in effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Thirteen – General Provisions:
In the event that any article or clause contained in this User Agreement is cancelled or that any article or clause contained in the User Agreement is no longer valid, such matter does not cancel the validity of the remaining articles, clauses and provisions contained in the User Agreement and they remain in effect until further notice from the store management
This User Agreement – which may be amended from time to time as appropriate – constitutes the User Agreement, the mechanism of work, understanding, agreement and contract between the store and the consumer, and both parties to this agreement agree to take into account the following:
1- The Arabic language is the language used when interpreting the provisions of this agreement, or when translating it into another language.
2- All prices displayed on the store’s services or products may be amended from time to time.
3- The promotional or marketing offers that the store may place are temporary offers, as the store has the right to amend or stop these promotional or marketing offers at any time.
4- The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules and applicable regulations and laws related to the nature of the dealings between the store and the consumer.
5- This User Agreement shall not be cancelled except by a decision issued by the store management.
